Especiale by Angela Costanza Conte is the owner of the e-commerce website www.e-speciale.it.
The purchase of products from the site presupposes the Customer’s knowledge and acceptance of the general conditions of sale described below:

The Administrator acknowledges no warranty, whether express or implied, in relation to the Site and its content, including as to completeness, accuracy and quality.

Acceptance of the general terms of sale
Orders are accepted only and exclusively through the Internet electronic cart of www.e-speciale.it.
The order placed by the customer is subject to acceptance by Especiale by Angela Costanza Conte.
The customer who sends the order via the Internet will receive, at the end of the procedure, a confirmation communication of the order placed, by electronic mail (E-mail), indicating the related order number.
At the moment of sending the order, a contract of sale is considered concluded and the Customer, by placing the order, declares to have taken note of all the information provided to him and to fully accept the general and payment conditions transcribed below.
N.B.: If you change your mind and wish to cancel the order, we kindly ask you to inform us promptly via email at info@e-speciale.it.

If the Customer is a natural person who purchases goods for purposes not related to his or her professional activity, once the online purchase procedure has been completed, he or she must print or save an electronic copy and keep these general conditions of sale, in compliance with the provisions of art. 49 of Legislative Decree 206/2005 on distance sales.

Product availability
In the product catalog published on the website www.e-speciale.it, the availability of products, even though constantly updated, depends on our suppliers and may undergo changes not in real time and without notice.

Orders placed by individuals operating within the scope of their profession or by companies must authenticate themselves as such when entering the order. If they do not, the orders are considered placed by consumers.

The Customer may purchase the products, viewable and described, on the website www.e-speciale.it bearing in mind that the images of the products may not be perfectly representative of their characteristics but may differ in color, size, or accessory products shown in the picture.
The information on each product is taken from printed or electronic informational material of the manufacturing companies, which reserve the right to change product information at any time, without any notice.

Any right of the Customer to compensation for damages or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or things, caused by the non-acceptance, even partial, of an order or by cancellation due to non-payment within the set term of an order.
If the ordered products are available in stock, your order will be shipped immediately after receipt of payment for the order.

If within an order some products exceed the availability in stock, you will be contacted by email by Especiale to provide estimated delivery times for the ordered goods.

If payment is made by postal current account or bank transfer, please note that shipment will take place only after receipt of payment for the order with relative value date.
For urgent shipments, we recommend paying by Credit Card or Poste Pay through the PayPal circuit.

Prices
All prices displayed on the website www.e-speciale.it are intended as prices INCLUDING VAT (for professionals, VAT is to be understood as excluded).
VAT is applied at the rate of 22% on most items except for sugared almonds, candies, etc. (food items), where the VAT rate is 10%.

Shipping rates may be changed at any time without any notice.

Purchase methods
Receipt of the order is confirmed by automatically sending an email to the Customer’s email address, with all the details of the order placed, order number, date, products purchased, total amount due, registration address, and, if different, the shipping address. The Customer must verify the accuracy of the data and communicate any corrections.

Sending the confirmation email for receipt of the order is always done subject to acceptance of the order by Especiale by Angela Costanza Conte; in case of non-acceptance, immediate notice will be given.

For the products sold, an invoice is issued for those who have identified themselves as a company with a VAT number.
The data for the issuance and sending of the invoice will be those indicated by the Customer at the time of registration; it is the Customer’s responsibility to notify Especiale by Angela Costanza Conte via email at info@e-speciale.it of any changes.
No change to the invoice will be possible after it has been issued.

Right of withdrawal
Pursuant to Articles 50, 51, 54, 57, and 59 of Legislative Decree 206/2005, anyone purchasing goods for purposes unrelated to their professional activity (who do not indicate a VAT number) has the right to withdraw from the purchase contract for any reason, without having to provide explanations or pay penalties.

As soon as we receive the notice of withdrawal, we will inform the Customer of the procedures for returning the goods, which must reach us within 10 days of authorization.

The right of withdrawal is subject to the following conditions:
The right of withdrawal applies to the entire product and its accessories; it is not possible to withdraw only on part of the purchased product. Once opened, the purchased good must be intact and well preserved, as must the original packaging and any accessories and accompanying documentation. Upon its arrival in the warehouse, the product will be examined to assess whether there are any damages or other issues not attributable to transport.
The Customer is responsible for shipping the product until its delivery to our premises. The shipping cost is borne by the Customer.
In any case, we are not responsible for damage, theft, loss, or tampering for goods returned with uninsured shipments.
The right of withdrawal lapses for lack or damage of the original external packaging or the original internal packaging, lack or damage of parts, accessories, manuals of the product, or its damage for reasons other than transport.

In this case, the product will be returned to the buyer, who will be charged the shipping costs.
The right of withdrawal is excluded by law in the following case:
For the purchase of items produced or created specifically for the consumer, such as ribbons, napkins, personalized cake toppers, and in general all products that can be customized on the website.

Once the necessary information has been acquired to establish the integrity of the product and all its parts, including packaging, and once integrity has been confirmed, reimbursement of the amount paid by the Customer for the purchase of the product (excluding shipping costs) will be made within 15 days from delivery of the product subject to withdrawal.

The Customer must communicate the bank details (IBAN code) of an account in their name to which the refund will be made.

Legal warranty for lack of conformity
Especiale provides an official warranty for a period of 24 months from the date of purchase, in accordance with Legislative Decree 206/2005.
The Consumer forfeits the right to enforce the warranty if the defect of conformity is not reported within 2 months from its discovery.
The warranty is valid for the following defects:
• the product does not correspond to the agreement;
• the product does not possess the essential characteristics;
• the product does not correspond to ordinary use and quality.

Especiale shall not be held liable for any damages resulting from improper use or wear, handling, or non-professional installation.
The warranty does not apply in cases arising from factors unrelated to the normal use of the product, such as drops, exposure to water or fire, or improper or abusive use by the Customer or by third parties not authorized by the manufacturer. The warranty is also excluded for defects already known to the Customer at the time of purchase. Procedure: Before returning a non-compliant item and in order to exercise the warranty, the Customer must agree—also by e-mail—with the Seller on the return and delivery procedures for the product. Especiale undertakes to inform the Customer of the place and method of shipment. Once the Product has been received, Especiale will carry out the necessary inspection. If a lack of conformity is found, the Customer will receive either the repaired product or a replacement. If, following inspection, the product is found not to have any lack of conformity, Especiale will inform the Customer of the costs required for its repair or replacement. The transport costs for products that do not show any lack of conformity shall be charged to the Customer. In the event of a claim regarding a lack of conformity, Especiale will promptly contact the Customer to provide information and, if applicable, propose replacement of the defective product with an alternative of equivalent or superior value and quality, or a refund.

Payment methods: Payment must be made and notified within 5 working calendar days from receipt of the order confirmation, otherwise it will be considered void. The days required for processing your order will begin from the time payment is received.

We accept payments by credit and debit cards, PayPal, Klarna, Satispay, bank transfer, and cash to the courier on delivery by choosing “cash on delivery.”
Attention: if you choose to pay by bank transfer, Especiale by Angela Costanza Conte will wait for payment confirmation before shipping the goods, and in any case, payment must be made within 5 days from when the order is placed, after which (if no other agreements exist) the order will be canceled, and the contract terminated for non-fulfillment.

Cash payment to the courier upon delivery
We also accept cash-on-delivery payments for orders shipped within Italy at an additional cost of €5.00 + VAT in addition to shipping costs (by choosing cash on delivery as the payment method, the additional amount will be calculated directly in the cart).
Attention: We do not accept cash-on-delivery payments for personalized items, custom orders, or orders exceeding €250.
The total must be paid in cash to the courier at the time of delivery, in the exact amount to the cent.

Liability
Especiale di Angela Costanza Conte assumes no responsibility for service disruptions due to force majeure and/or unforeseen events such as accidents, theft and/or robbery of the delivery courier, fires, explosions, strikes and/or lockouts, earthquakes, floods, and other similar events that prevent, wholly or partially, the execution of the contract in the agreed times and ways.
